Terms of Service

1. Acceptance of Terms

By accessing or using the TSS Payroll platform (tsspayroll.co.za), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms constitute a binding agreement between you (the "Customer") and Treasure Digital Group (Pty) Ltd ("we", "us", "our").

2. Description of Service

TSS Payroll is a cloud-based payroll and human resources management platform designed for South African businesses. The service includes payroll processing, PAYE/UIF/SDL calculations, payslip generation, leave management, employee self-service, and related HR features.

3. Account Registration

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be 18 years or older and authorised to act on behalf of your organisation.
• One account may manage multiple companies ("tenants") under your subscription.

4. Free Trial

We offer a 14-day free trial with no credit card required. At the end of the trial period, your account will be restricted unless you subscribe to a paid plan. Trial data is retained for 30 days after the trial expires.

5. Subscriptions and Payment

• Subscriptions are billed monthly or annually as selected at sign-up.
• All prices are in South African Rand (ZAR) and exclude VAT unless stated otherwise.
• Payments are processed securely via PayFast. We do not store card details.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are not provided for partial billing periods, except where required by law.

6. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of South African law
• Attempt to reverse engineer, copy, or reproduce any part of the platform
• Upload malicious code, viruses, or disruptive content
• Share or resell access to the platform without authorisation
• Use the platform to process data for individuals without their consent

7. Customer Data and Privacy

You retain ownership of all data you upload to the platform (employee records, payroll data, etc.). We process this data on your behalf as a data operator under POPIA. Refer to our Privacy Policy for full details. You are responsible for obtaining appropriate consent from employees whose data you enter.

8. Compliance Responsibility

TSS Payroll provides payroll calculations as a tool to assist compliance with South African tax law (PAYE, UIF, SDL). However, you — the employer — remain legally responsible for the accuracy of all submissions to SARS and the Department of Employment and Labour. We recommend you review all calculations before submission.

9. Service Availability

We aim for 99.5% uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by factors outside our control (third-party providers, internet outages, force majeure events).

10. Limitation of Liability

To the maximum extent permitted by South African law, Treasure Digital Group (Pty) Ltd shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the 3 months preceding the claim.

11. Termination

You may cancel your account at any time from the account settings. We may suspend or terminate accounts that violate these terms. Upon termination, you may export your data within 30 days before it is permanently deleted.

12. Changes to Terms

We may update these Terms from time to time. We will notify you via email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
